In no event shall CaseBob Sweden, its parent company, subsidiaries, affiliates, or any of their respective directors, officers, employees, agents, or suppliers (collectively referred to as "CaseBob") be liable, whether under contract, tort (including negligence), or otherwise, for any indirect, incidental, consequential, special, exemplary, or punitive damages, including, but not limited to:
- Loss of value of the product or any third-party products that are used in or with the product, even if CaseBob has been advised of the possibility of such damages;
- Loss of any consumer devices; loss of property;
- Losses relating to any business of yours, including but not limited to, loss of profit, loss of opportunity, or interruption of business;
- Loss of data stored on the device, inability to access data, or loss of use of the device or any associated equipment.
The entire liability of CaseBob and any of its suppliers shall be limited to the amount paid by you for the product that gave rise to the claim. This limitation of liability applies to the maximum extent permitted by law.
No Express or Implied Warranties
Except as expressly set forth in the warranties provided here, CaseBob makes no other express or implied warranties of any kind whatsoever with respect to the product, including but not limited to merchantability, fitness for a particular purpose, design, condition, quality, or performance of the product. In addition, CaseBob will not be liable for any damages of any kind resulting from the purchase or use of the products, including incidental or consequential damages or loss of profits or benefits.
Warranty Waiver
CaseBob reserves the right to waive responsibility for warranty coverage under the following circumstances, including but not limited to:
- Warranties implied by authorized or unauthorized sellers;
- Warranties expressed in written or verbal form by non-genuine or counterfeit CaseBob product distributors or vendors;
- Any attempt to misuse or abuse the warranty for financial or personal gain.
Exclusions from Warranty Coverage
Defects caused by any other accident, including but not limited to:
- Failure of proper installation;
- Negligence or carelessness by the user;
- Damage caused by improper use or maintenance by the owner, such as exposure to extreme conditions, misuse, or unauthorized modifications.
In cases where the product was purchased as part of a package, only the defective product in the package will be subject to the warranty remedy.
Applicable Law and Jurisdiction
This Limitation of Liability shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising under this Limitation of Liability shall be resolved in the courts of Gothenburg, Sweden.
Changes to This Limitation of Liability
We reserve the right to modify this Limitation of Liability at any time. The most recent version will always be available on our website, and significant changes will be communicated to our customers as required.
